1st Case of a Sound Mark

S&BM represented INTEL Corporation in the first sound trademark registered in Argentina.
It was filed on December 12, 1997 in class 9 and granted on June 13, 2000. With this trademark, the path for dozens of sound marks in this country that followed its steps was opened.
Given the novelty of the issue and that the National Board of Industrial Property did not have any special requirements or formalities for the filing of this kind of marks such as it is today, the application form was filed with a stave containing the five music notes composing the sound mark, along with the information required for playing it correctly as well as magnetic carriers with the recording of the notes D,D,G,D and A.

S&BM has maintained the criterion as of today about the way the applications for these kinds of marks are to be filed. Thus, sound marks should be filed in all cases along with a written description, a carrier containing a recording of the sign applied for and, if possible, its reproduction on a stave. We also maintain that it is viable to register a sound mark of sounds that cannot be represented on a stave.
