Issuance of Digital Certificates of Registration. |
|
Furthermore, the National Board of Industrial Property (INPI) implemented the issuance, signing and notification of Certificates of Registration in digital form, thereby taking one more step into the prosecution of trademarks online. (For more information, please read our Newsletter 2).
The certificates of registration are digitally signed by the INPI and their issuance is automatically notified by means of an electronic mail to the address declared in the corresponding administrative file. In addition, an alphanumeric identification code that allows downloading and browsing the document is forwarded. |

The digital issuance of Certificates of Registration proving the registration of new Trademarks as well as renewals was implemented by the National Board of Industrial Property (INPI) through Resolution P-341 of September 9, 2013.
In addition, Provision M- 1292/13 regulated said Resolution.
Thereby, it is enforced what Act 25,506 provides for, which acknowledges the validity of an electronic document and digital signature in the Argentine system. The electronic document digitally signed by a competent authority is considered “original” and has probative value as such.
It should be highlighted that the authorities shall digitally issue all the certificates of registration of word marks and those of figurative or composite marks of which the logotype, isotype or logo designs have been entered in the INPI's computer system. Otherwise, the Certificate will be issued in paper format. |
